Kashif Al-Ghita’ writes: ,,The scholar of the law (Mujtahid) is allowed, to collect alms and to send messengers and one must pay them to him and them, when they did not come out with it and he is the deputy of the Imam (a.) in the judgments and the same is the case with the fifth part (Khums) and all the privileges of the needy, because he is their guardian (Waliyy) and his presence is an expression of their presence. This includes as well, that he is allowed to force, those who resists the privileges and if there is a refusal, he takes it even with the help of a tyrant or with the support of the military.” [Kashf-ul-Ghita’, volume 4 page 135]

قال الشيخ كاشف الغطاء: انه يجوز للمجتهد طلب الزكوة وارسال السعاة ويلزم التسليم إليه واليهم ان لم يكونوا سلموها ويقوم مقام الامام في الاحكام وكذا في الخمس وجميع حقوق الفقراء لانه وليهم وحضوره عبارة عن حضورهم ومنها انه يجوز له جبر مانعي الحقوق ومع الامتناع يتوصل إلى اخذها باعانة ظالم أو بمعونة الجند كما له ان يتوصل بذلك في تحصيل حقوق المظلومين لان الاصل عدم جواز التسليم إلى غير المجتهد في الحقوق العامة الا ما قام الدليل على خلافه
