Al-Khamina’i on Khums

Ali Al-Khamina’i writes:

Question: ,,If the judge is one person and the example of imitation (Marja’) is another person, to whom should the fifth part of the fee (Khums) be given?

Answer: It is obligatory to pay the Khums to the owner of the Khums, who is the one in charge of the affairs of the Muslims, unless the opinion of the scholar of independent law-making (Mujtahid) whom he imitates does not agree with it.” [Ajwibat-ul-Istifta’at, Volume 1 Page 302]

قال علي الخامنئي: السؤال إذا كان الحاكم شخصا ومرجع التقليد شخصا آخر فإلى أيهما يجب دفع الخمس؟ الجواب يجب تسليم الخمس إلى ولي أمر الخمس وهو الذي يلي أمور المسلمين إلا أن يكون فتوى المجتهد الذي يقلده غير ذلك
